Disbanded Gauteng Netball Structures take NSA to court for unfair dismissal

Netball South Africa (NSA) stands firm in its decision to dissolve the Gauteng Netball Provincial Structures due to alleged malpractice and maladministration, replacing it with an interim committee.

The NSA has scheduled a fresh election date for voting on a new board between 29 June and July this year.

Despite facing legal action from Gauteng in the High Court seeking to overturn the disbandment, the NSA remains resolute, refusing to yield to their demands.

The NSA has issued a letter, seen by SABC Sport, addressed to the Gauteng Netball Provincial Structures dated March 7, 2024, informing them of their suspension and detailing the reasons for their dissolution.

The reasons are malpractice and maladministration, including failures to provide necessary information, disregard for established procedures, deficient record-keeping practices, and the maintenance of misleading and inaccurate records.

Additionally, the organization has cited structures and procedural dysfunctionality, a lack of transparency, and discord among members at the district level. Ethical lapses and maladministration by executive members, governance malpractice, financial inadequacies, and constitutional and policy violations have also been noted.

Furthermore, there is a deficit in development, high-performing programs, and strained relationships with associate members and districts.  

According to evidence presented by the NSA, NSA President Cecilia Molokwane revealed exclusively to SABC Sport that the governing body has opted to dissolve the current structure and put them under administration immediately.

Claudine Klaasen – Director Demarcations, Lindi Mgweba, Malefo Monnyana (West Rand), Bonga Ndaba (Ekurhuleni), Keke Lebusa (Sedibeng), Dumakazi Mathebe (Tshwane), are part of the new interim committee.  

 “They (Gauteng Netball Structures) promptly proceeded to the High Court. While they consulted their legal representatives, we too explored our legal avenues.  They initiated legal action against us without grasping the rationale behind our structural dissolution. If their intention is transparent, why resort to litigation? I’ve shared ample insights, but I must refrain from further elaboration as the case now rests without legal counsel. We await the scheduling of court proceedings. As the matter is under the legal purview, I am constrained in divulging more,” disclosed Molokwane.

The interim committee must coordinate Netball Indaba and constitutional amendments, submit financials for auditing, and report to be tabled to the NSA President, for review by EXCO. Develop a strategic plan for Gauteng Netball with the districts among other duties.
