The trio made their second appearance at the Palm Ridge Commercial Crimes Court in Katlehong this morning; they were arrested on the 13th of last month on allegations of theft and fraud and granted bail of R20 000 each.
The NPA’s spokesperson, Phindi Mjonondwane, expands on the three applications brought in this case by the State and the defendants.
"Okay, the matter has been postponed to the 10th of December. The court will be hearing two different applications, one by the state, where we are alleging that the lawyer representing Mr Jordaan is conflicted and we will be bringing forth such evidence before court and the court will then take a decision,” Mjonondwane said.
“So, obviously if the court finds that indeed he is conflicted then Mr Jordaan will have to find another legal representative. The second application is brought by the accused persons, they are sighting unreasonable delays so they are bringing an application in terms of section 342, capital letter A of the Criminal Procedure Act.
“So, the court will be entertaining both applications, and as the state as we'll be given an opportunity to respond to the allegations of unreasonable delay."
Jordaan and Hluyo were on Thursday represented by former SAFA NEC member and legal guru Advocate Norman Arendse, but the State is bringing in an application of its own, claiming that Arendse is conflicted and cannot represent them in this case.
"Well, as a state we received information that he performs legal duties for SAFA and SAFA is the complainant in the matter and Mr Jordaan is now an accused where SAFA is a complainant but obviously, we cannot bring our case through the media much of that evidence will be diverse in court," she added.
Mjonondwane also confirmed that Jordaan and Hluyo are bringing an application to have the case struck off the roll, citing unreasonable delay.
Jordaan is accused of having violated SAFA statutes and used the company’s money for personal use, paying R1,3 million to PR firm Grit Communications in a PR campaign at the height of the rape allegations against him by Jennifer Ferguson. Mjonondwane wouldn't be drawn into discussing a list of witnesses that has been reported about in the media, but she’s sure that they’ve got a strong and winnable case.
"The evidence in the docket passed the test of prospects of a successful prosecution hence the matter is before the court. Regarding a list of witnesses that is circulating as a state, we are not aware of such, unless such lists were attached to the charge sheet which is a public document."
